Man Sentenced for Killing Toddler Over Broken Xbox

Tyrone Spellman was sentenced to 20 years in prison for bashing his 17 month-old daughter's skull after she accidentally pulled his X-Box to the floor.PHILADELPHIA (AP) -- A man who killed his 17 month-old daughter in a rage over a broken Xbox has been sentenced to more than 20 years in prison.

Philadelphia prosecutors say 27 year-old Tyrone Spellman killed Alayiah Turman in September 2006 with at least five blows to the head when she pulled down his Xbox console. The force of the blows cracked the toddler's skull.

Spellman was convicted in January of third-degree murder and child endangerment. He was sentenced Thursday, March 13, 2008, to the maximum 22½ to 45 years in prison.

Spellman confessed to police but defense lawyer Bobby Hoof says the statement was coerced and that he was just trying to protect the child's mother.

But at Thursday’s hearing, Spellman expressed remorse.

The couple's other child, born after the killing, is in city custody.

Does it matter what he used as a weapon?

Why do we have to pay for this guy to eat and sleep for 20 years? He should be shot in the face until dead (by a guy dressed up as Master Chief.)

The subject of people's rage issues is irrelevant.

This is the same sort of asshole who 100 years ago would have killed the girl because she knocked over his whiskey bottle.

This is the same sort of asshole we read about last year who dumped a toddler in the snow a mile from home and and let her die of exposure after beating her because she wanted to play in a mirror and wouldn't go to sleep.

Some people just have no business with children, unfortunately you often don't know this until it's too late... or too late to do anything about it.

My mom stepped on my double size Uncanny X-Men #137, (Death of Jean Grey) creasing the cover when I was a kid. I flew off the handle but I didn't do anything beside yell at her.

That I still remember it to this day goes to show that little things can create big drama. They key is to restrain yourself so you don't kill anyone!

I shouldn't have said something so awful. Even in anger over such an awful attack like 9/11. I should have realized how level-headed and peaceful the Muslim religion is and not shouted out in anger against the entire group when it was just a small, brave and radical sect of folks who were just trying to teach the evil Americans a lesson.

A 2-year-old girl died Monday night at Hershey Medical Center after, police said, her mother's boyfriend beat her with a video game controller and cord Sunday in York.

The girl was in the critical care unit in a vegetative state on life support with multiple injuries, the most dire being injuries to her brain, said York City Detective First Class Dana Ward, who supervises the child abuse unit.

"She never regained any kind of consciousness," Ward said late Monday night.

The toddler was declared dead at 9:28 p.m., said Lt. Ron Camacho, who commands the city's detective division.

Police and ambulance personnel responded to the mother's home in the 700 block of West Philadelphia Street in York for an unresponsive 2-year-old child. The toddler had visible bruises, marks and lacerations to her head, back and body, Ward said.

The child's mother, Neida E. Baez, 19, is charged with endangering the welfare of a child. The mother's boyfriend, Harve L. Johnson, 26, is charged with aggravated assault, simple assault, endangering the welfare of a child and reckless endangerment.

The couple lived together, Ward said.

Investigators said earlier in the day that charges could be amended if the child's condition changed.

As of Monday evening they were being held in York County Prison, Johnson in lieu of $200,000 bail and Baez in lieu of $25,000 bail.

A preliminary hearing has been tentatively set for 9 a.m. April 17 before York County District Justice Richard Martin.

During questioning at the police station, Johnson admitted to beating the girl but did not say why, Ward said. The toddler was beaten with a video game controller and cord, according to charging documents.

Just before 2:30 p.m. Sunday, the mother and boyfriend had called 911 to report the injured toddler, Ward said. After the beating, Johnson put the toddler in a bathtub to revive her but she remained unresponsive, according to court records.

Johnson then brought the wet, limp and unresponsive child to Baez and the two began CPR, court records say.

Afterward, the mother told police Johnson was beating her daughter and the child was screaming and then stopped, according to charging documents.

Baez was charged because she was home when Johnson allegedly beat the toddler but did not intervene or try to get help, Ward said.

"She (Baez) heard the beating take place," he said. "Her crime is she did nothing to protect her child."

Investigators are in the process of getting the toddler's medical records and having a complete medical profile conducted at Hershey Medical Center, Ward said.

When questioned at the police station, Baez and Johnson were "very emotional," Ward said. The mother was weeping and sobbing and requesting updates on the condition of her child, he said.

Police and emergency personnel had a stress debriefing Sunday evening to deal with a helpless child being so brutally beaten, Ward said.

"Anytime a child is injured, it is very difficult for patrol officers and emergency personnel," Ward said.

Yeah, that one.

I don't know that I would be able to maintain that level of self-control, discipline, but would only be able to remind myself that it was the lack of self-control that led to such a tragedy.

Mind you, this wasn't both parents, it was the mother's boyfriend.

Remember: It's OK if your boyfriend beats up your toddler. As long as she stops crying there's nothing to worry about...
