I love this story..

Caught in the act with her lover, Tracy Denise Roberson -- thinking quickly, if not clearly -- cried rape, authorities say. Her husband pulled a gun and killed the other man with a shot to the head.

On Thursday, a grand jury handed up a manslaughter indictment -- against the wife, not the husband.
In the end hopefully the guy will walk with no charges and she will spend a few years in jail. Gota love Texas.

When Tracy Roberson cried that she was being raped, LaSalle tried to drive away and her husband drew the gun he happened to be carrying and fired several shots at the truck, authorities said.
I still think he needs to do some time since the guy was in the process of leaving. Not as much as her though.

I think his reaction was wholly reasonable and that one should not be punished for using deadly force when trying to protect their wife from being raped. That said,

If it was my wife and I thought she'd been raped, I wouldn't give much of a fuck about where he was when I caught up to him. It may sound redneckish or something, but better to kill him and claim temporary insanity brought on by the distress of your wife being raped, than let him live and deal with him suing you for touching him. Justice doesn't always get sunlight.

I was merely pointing out the reason why I would think he should or shouldn't face charges. When someone is driving away, it's no longer self-defense and it's more of a vigilante justice situation, and he can and probably will face charges for that.

I think anyone would, and as such he shouldn't face any charges.

I can damn well guarantee you that if I caught someone raping my wife I wouldn't even hesitate to kill them. I'm not a violent person, but raping a women in my opinion is about one of the most heinous things someone can do. There are times when the law/justice just doesn't suffice, and I know that if faced with that situation I wouldn't be able to hold back.

It may be slightly different if it was later on that an attacker was identified or something. I'm not saying the feelings of revenge wouldn't be there, but I think at that point that the discovery would take place in a more civil environment, not allowing the aspect of revenge to be carried out. (Save for the dads you see pull a gun out in court and blow away some child molester that raped their little girl or something).

I guess it boils down to who got their hands on the person first... if it was me they wouldn't be around much longer. For you goody goody types that are going to pull the "Our society states that all criminals deserve to have a trial and punishment determined by the justice system" I say the person made their choice when they decided to rape someone, and if it was my wife, that makes me the resulting judge/jury.

I'm a very laid back and peaceful person, but mess with my family and it's a different story, and I'm sure 90% of the men here would feel/do the same thing given the situation.
