I'm too lazy to go look it up, as I recall the complaints against the hate crimes bill were that pretty much anything can be prosecuted as a hate crime the poor way it was written. Piss on your neighbors' lawn? Oooh, he's a different nationality, must be a hate crime.

Of course a prosecutor trying to increase his stats would never do that, nope.
