I saw another forum ranting about the lawsuit. I don't really see a problem with it? Is it too much to expect to take a flight somewhere without some deranged lunatic cumming on your hair?

Is it called Punitive damages? I'm not sure, maybe Sueven knows. I'm all for it though.

I am gonna go ahead and guess that IF a flight attendant did walk by during the process, he hid his junk so they wouldn't see. How is it the airlines responsibility? There was a sick fuck on the flight, no one could have known.

Airlines pretty much have a responsibility to make sure you don't get jizz on your hair while on their plane. Pretty straightforward case.

I doubt any staff saw it happening, and if they didn't see it how can they prevent/stop it....

It's a negligence lawsuit, I assume. I haven't read up on the allegations, but I'd imagine there's one of two theories:

First, she could claim that the airline knew that something was happening and failed to take steps to stop it. If she has some evidence that the airline knew (she at least seems to have statements saying that the flight attendants noticed the man switching to the seat next to her), this one seems pretty uncontroversial-- yeah, if I'm on your plane, and you watch someone masturbate on me while I sleep, I'd say it's your duty to do something.

Second, she could claim that the airline was negligent in failing to notice the behavior-- they had a duty of attentiveness that's high enough that it encompasses making sure passengers aren't masturbating. This one might be more dicey, depending on the specific facts and whatnot, but it doesn't seem unreasonable to me. Is it that hard to notice some guy masturbating? I sure as hell couldn't be subtle enough to escape being noticed during a whack-off session on an airplane.

I'd assume that she's requesting punitive damages, basically meaning she wants damages above and beyond actual damages. This seems pretty reasonable, given that actual damages are probably pretty low, somewhere around the cost of a good bottle of shampoo.

I'm still standing by what I said. Sueven, I don't really buy either of those scenarios and I think a good lawyer (which I'm sure the airline has) could poke a billion holes in either of them.

If no one around him noticed, then is it surprising that the flight attendants did not? If I am the airline, I would make that point. I am more surprised there was no one in the area that did not notice the guy beating off. Every flight I take is pretty full, I would think I would notice some dude pulling his meatstick.

Also how hot would a girl have to be to want to go to jail over? I can't even imagine this thought passing through my mind. I enjoy seeing pretty girls as much as the next guy, but I am not going to go over and beat off on them...unless they ask.

Might be right, although it really depends on particulars. With regard to the first scenario, if employees really did see him beating off, and she can get them to testify to that in court, it'll be pretty hard for even the best lawyer to get out of that one. With regard to the second, if the law says that airlines have a very high duty to police their airplanes (i have no idea if this is the case or not), then it might again be tough-- if that's the case, she might win as a matter of law with little to no argument necessary. We'll see.

Tyek, I'm curious as well. Maybe he was really subtle. Maybe they noticed and didn't say anything.

I didn't say it was unreasonable Nick, I was simply pointing out that I fly quite a bit, and on almost any flight I have been on, that kind of activity would have been noticed by the passengers due to the high volume of people on board.

The fact that he was able to move seats to get next to her seems to imply the flight was fairly empty, but if someone sitting close (i.e. there were people in front of her that noticed after the fact) and they did not hear or see him jacking it, how can an attendent.

I think they noted that this was in the last 20 minutes of the flight when they are prepping for landing. They may have already been through the cabin and were getting settled themselves. We also get severe wind out here this time of year so they may have been forced to remain in their seats. There are tons of variables.

I think she should sue the hell out of the guy for his behavior. He should also be charged with aggravated assault since he soiled her with something that could cause harm if he has some type of disease. The airline will probably settle the case for 20-50K to keep the information for making the news over and over again, but they would probably win in a court case.

Well..um... tough shit? The Airline already stated it saw the man standing up and moving towards the sleeping woman. Another case of "attacking the wrong person at the expense of the victim" fucked up logic.

I think she's suing the wrong party, and it is only because she could potentially get more money from the airline than the guy who did it.

The problem is that we don't have all of the facts. As someone pointed out, the other passengers didn't notice. If they didn't, in my opinion it makes sense that the attendants may not have. The dude probably was extremely careful and stopped any kind of bizarre behaviour when the attendants were in the area. Also, for all any of us know, there was turbulence or another type of situation which made moving about the cabin impossible for the attendants or anyone else.

I don't know. I think we live in a sue-happy society. If the airline is actually responsible, I agree that they should be held accountable. I just rather see a criminal charge if they *were* negligible than a silly civil suit.

Blame the system, not the person who is using it properly.

Also: A flight attendant noticed the man change from his ASSIGNED seat to one next to the woman. You are not allowed to change seats at will on an airplane, even if the flight is mostly empty. A flight attendant allowed the man to do this, and because they allowed this, a woman got jizzed on. I see no way in which the airline employees were not responsible for this happening, assuming it's true that they saw the man change from his assigned seat, as the article says.
