A peek into the US justice system.

Found this on the FOH General board, thought this was a reallly good read, though very long. It's a post about someone's past experience with American Justice. I knew it was far from a perfect system, but this is just scary.

Yeah, I know its just a Blog, not a credible news source, but there is some very interesting stuff within.

the guy made some pretty rookie mistakes. not to say that he deserved what he got, but some things you don't do ever is confess or sign anything without a lawyer, and never plead guilty to an elected official who 99% of the time is trying to look "tough on crime" to his constituants.

any law enforcement officer's job ultimately is to arrest you. if they don't get collars then they will lose their job. they are legally allowed to say just about anything to you in order to get you to confess to a crime. the most popular and widely used method is called the reid method, which is a psychological technique specifically designed and perefected over decades to trap anyone into confessing just about anything. once that confession is made, most of the time it is admissable in court.

if you just outright plead guilty to a judge then he is going to throw the book at you unless you've made a deal with the DA. nothing is easier for a judge than someone who just pleads guilty. the judge can then give out maximum sentence and his man-years sentenced stats go up. this makes him look good in front of his voters because americans generally support judges and sherriffs who are hard on criminals. if the judge is an appointed fed judge it is even worse because they can be bounced out on the whim of another politician.

the american justice system is an archaic joke.

The American Justice system is outdated. However, it still remains one of the better systems in the world. The main problem with it is that legislators constantly pass laws every year without going back and getting rid of old ones. For example - In the State of Louisiana the law states that if you own land you can carry a sword in public. Or in North Carolina on Sundays you can beat your wife on the courthouse steps legally. Somehow I do not think the average cop will just sit back and let these things happen.

Another problem is that we focus too much on the rights of the convicted. The rights of the accused are good and better than other countries. Yet if you are a convicted murderer you are still eligable for benifits when you get out of jail.

Also when dealing with the law always use common sense. First thing you do is call an attorney, second start thinking about why you got in the situation that you are in. Police are there to do a job most people do not want, and they would rather be out in a donut shop than running around arresting people.

As for this story I would like to know the details, and both sides of the story. I know I am cruel but if you commit a crime you get punished. Hopefully this guy will think twice about defrauding people.

Louisiana is kinda the red-headed step child of American Law...can't tell you how many times I've heard "this is true for most states, except of course, Louisiana"

You have to love Napoleanic code (whats it's called here). In some ways it's better than the other 49 states.
