It wont win
First of all, if it goes to court, the defendant could say any surgeon could leave an expensive item in the body and charge them for the extra surgery.
Next, any surgeon that does do this is gonna have a lot of luck getting another surgery again.
Also, what if she goes to a different surgeon, gets it taken out, and lets the surgeon keep it for the bill? Might not win but hey, what a good way to get revenge!

Any dumbass who misplaces a $21,000 watch deserves it. The fact that he is a doctor and apparently lost it within a patient just goes to prove his dumbassedness.

That doctor should have his license taken away. He made the mistake in the first place and should be prosecuted for his mistake and have to pay for her extra surgery to have the rolex removed.

Good god- if I were him I'd be absolutely shitting myself in fear of a huge malpractice suit and loss of my license. It's obvious he didn't do the proper pre-operative disinfecting scrub like he should have, and god only knows what bactieria was on that watch.

I'd have called my lawyer from the Dr's office about .4 seconds of seeing that watch in the x-ray.

Why is there nothing in the story about the Hospital he did the surgery at booting his ass off there staff....Because just about any hospital would have booted this guy out just for scrubbing in with a watch on....Most gall bladder surgeries are done by laproscoptic means anyways....not many by 4cm incision.

What about contamination? Why isnt this Women severly infected about to die from contamination from his watch?

Why isnt this Dr. being sued out his ass?

I really find this story a crock of undermining BS....without more info.
