Wow...this is fun!MONTREAL - Lawyers in Montreal say Canada may be violating the Constitution and international law by using a security certificate to hold a man suspected of terrorism.
The lawyers were in court Wednesday on behalf of Adil Charkaoui.
Charkaoui, a Canadian permanent resident, was arrested in May on a security certificate after the federal government declared him a national security risk.
The Canadian Security Intelligence Service (CSIS) accused him of being a sleeper agent associated with the al-Qaeda terrorist network and said he should be deported to his native Morocco.
Not allowed to see evidence
But constitutional lawyer Julius Grey told a Federal Court justice Wednesday that the whole security certificate process is unconstitutional because it doesn't allow Charkaoui to see key evidence against him.
The federal government guards that evidence on the grounds of national security.
"The taking away of those rights in our view with a certificate is inconsistent" with constitutional rights, he said. He said his client should have a full trial to answer the accusations against him.
Johanne Doyon, another lawyer representing Charkaoui, said the security certificate process violates a number of international agreements Canada has signed.
CSIS claims that Charkaoui trained at a terrorist camp in Afghanistan and knew convicted terrorist Ahmed Ressam.
He has always denied those claims.

Great now our government is doing it.
Using national security as an excuse to override a person's rights without proof is fucking bullshit. No matter which government does it.
When a government claim allows them to bypass the constitution the constitution becomes powerless.
I hope the court throws this shit out.
