I wouldn't really consider the hundred thousand or so signatures they had to get to force a recall in a state of 30 million people to be the will of the people. I would call it an electoral process in dire need of reform so it can't be manipulated by jealous conservatives to circumvent democracy, however.

the voting machines in question were already scheduled to be replaced, but they were on schedule to be replaced by the date of the normal elections, not the special recall elections.
this is all part of the political game gents. you should not be surprised if this sort of thing comes up along the way, and unless the GOP in Cal. is run by morons, they saw this coming down Hwy 5 as well.
having limited (if any) real legal knowledge, i would still be surprised if this does anything more than stall the process a bit. it is probably a diversionary tactic to get the GOP to have to waste time in the courts instead of focusing more effort in their campaign efforts (which are slipping).

No they aren't fine. The ACLU took them to court after the last election for the same exact thing, you know, when the democrats were voted in. The machines were supposed to be replaced before the next election. Well here is the next election and the machines haven't been replaced. Therefore, they moved to block the election again.
They are only the most overturned because they are predominantly liberal and the only court capable of reversing their decisions is predominantly conservative. If the situation were reverse they would still be the most overturned panel in the country and it really has nothing to do with the decisions they make. Although I'm sure in your mind if it were the other way around then they could do know wrong and SCOTUS would be the most evil bastards in the nation.

I live in one of the counties in question, we will have our machines in by the next scheduled election, also known as November. The recall wasn't a planned election, hence our people aren't trained on the machines/all the machines are not in yet. The recall is actually going to make it more difficult for them to be up in time (very little time for training) and we are not, as a county, being reimbursed the expense of this extra election.kyoukan wrote:No they aren't fine.
