Your 5th amendment right

Post by sarlen »

I found a link to this video from a news story talking about a kid who was room mates with a guy that consented to a search of a shared dorm room when the police did not have probable cause, needless to say it didn't turn out to well for the kids.

This is a great presentation from a lawyer AND a police detective on the pit falls of ever talking to the police for any reason...ever.

Part 2 http://www.youtube.com/watch?v=08fZQWjDVKE

edit..actually had the wrong video linked for part 2

One thing I know is that when being pressured to let the cops frisk you, search your car or house or whatever, do not answer yes or no, because they will ask the question repeatedly in different ways to get you to inadvertently consent. Always say "I do not consent to any searches," as there is not possible way to misconstrue that as consent.

p.s. These both refer to the 4th amendment, but I'm willing to let that slide because getting citizens to waive their rights is something ALL cops do far too often.

Quite interesting, everyone should really see this, just in case :)
