With the parents of the 20-year-old accuser looking on, District Judge Terry Ruckriegle threw out the case under a deal that means no charges will be refiled.
"The people have filed a motion to dismiss this case based on the fact the sole victim at this time is unable to go forward," District Attorney Mark Hurlbert told the judge.
How much you wanna bet she can continue in her civil lawsuit until she sees some serious green?
Well the civil case hasn't been dropped and isn't linked directly to the criminal case. However, since the prosecution dropped the case due to her refusing to testify.. well.. that is a major hit for her civil case as well.
According to a lawyer I just heard on the radio, if there's a settlement in a civil suit it can be completely out of the public record. He also said that the statement released today by Pamela Mackey:
Bryant's attorney, Pamela Mackey, read a statement from Bryant to the court.
"I want to apologize to her for my behavior that night and for the consequences she has suffered in the past year," the statement said.
Although Bryant stopped short of acknowledging guilt, he did acknowledge the alleged victim's viewpoint.
"Although I truly believe this encounter between us was consensual, I recognize now that she did not and does not view this incident the same way I did."
The young woman's parents did attend the hearing.
Lin Wood, an attorney for the 20-year-old accuser, said the civil lawsuit filed August 10 against the Los Angeles Lakers star will continue.
Bryant's statement acknowledged the civil case.
"That part of the case will be decided by and between the parties directly involved in the incident and will no longer be a financial or emotional drain on the citizens of the state of Colorado," the statement said.
Lays the groundwork for a private/out of court settlement in the civil suit and that he felt the way it was worded was a requirement for such a settlement.
Oh, my God; I care so little, I almost passed out.
Im guessing there is a deal in place, with Kobe's comments it lays the groundwork for him to give her a lot of money without ever going to trial. The he can say he isnt guilty but he see's her side of it and they settle it that way.
More likely it was some girl that was raped, but since Kobe has mad cash, a settlement has been reached where she won't testify and he gives her cash. Now, since that's illegal, but settling a seperate civil suit isn't...
