Teenager In Trouble In Inhaler Incident
A teenager was disciplined for sharing medication used to treat asthma, but he said it saved his girlfriend's life, News2Houston reported Wednesday.
Andra Ferguson and her boyfriend, Brandon Kivi, both 15, use the same type of asthma medicine, Albuterol Inhalation Aerosol.
Ferguson said she forgot to bring her medication to their school, Caney Creek High School, on Sept. 24. When she had trouble breathing, she went to the nurse's office.
Out of concern, Kivi let her use his inhaler.
"I was trying to save her life. I didn't want her to die on me right there because the nurse's office (doesn't) have breathing machines," Kivi said.
"It made a big difference. It did save my life. It was a Good Samaritan act," Ferguson said.
But the school nurse said it was a violation of the district's no-tolerance drug policy, and reported Kivi to the campus police.
The next day, he was arrested and accused of delivering a dangerous drug. Kivi was also suspended from school for three days. He could face expulsion and sent to juvenile detention on juvenile drug charges.
The mothers of both teenagers are angry.
"My son will not go to jail. This is ridiculous," said Theresa Hock, Kivi's mother. "I believe he shouldn't be punished at all because he was helping her. She was in distress."
"If he hadn't helped her, she would have passed out or died or something because her asthma's been really bad this year," said Sandra Ferguson, Andra's mother.
The school principal said he couldn't do anything about it since Kivi not only broke school rules, but also allegedly violated state law.
"It's simply a matter that it's classified as a dangerous drug. It's an inhaler form, but yet, if it had been in pill form or any other, it's still classified as a dangerous drug," said Greg Poole, the Caney Creek principal.
"Would Caney Creek had want Andra to have died rather than my son to help her?" Hock said.
Poole said the nurse never considered Andra to be in a life-threatening situation.
The school district will hold a hearing on the matter Friday.

But couldn't you argue that Kivi was administering first aid? I think this is a fucking joke, they need to look at this realistically and make a judgement call.
I can understand that these rules and laws are in place to protect our children. That's fine. They fail to see that they cannot make these huge, sweeping rules and not allow for some exceptions. If they don't then stupid shit like this happens.

For real, if they wanna see drug abuse they should come to my school lol, people bring all sorts of prescription shit to school and hand em out like candy, from Adderol (speed), to Muscle Relaxers, its nuts (of course, the Adminstration is full of dumbasses and they can never catch anyone, even though people do it in the fucking classrooms while TEACHERS ARE IN THERE).

Everyone wants "No tolerance" drug policies, then bitches up a storm when they're enforced. Tough shit, you can't have it both ways. You can give the principal the responsibility and authority to run his school, and take the heat if he screws up. Or you can place the matter in the hands of a no-tolerance policy and make it no ones fault.
Any non-flexible rule takes people (personal accountability and responsibility) out of the equation and is just asking for trouble. That's usually the intent, someone can point to the rule and say "Look! We have a rule against that! Not my fault.".

Think you're referring to the "Good Samaritan Act" mentioned in the article. It's there in some states as it's not a federal law I believe, but it's also too vague. People still find ways to sue the person who "saved" their life. As for the school system going after the student...what fucking dangerous drug did he deliver? They were both on the same medication to begin with. If they were seeing each other, my guess is that they knew this as well. It almost sounded like the Principal was just saying what he "had" to say, rather than what he "wanted" to say...but then again, this is just print media, so it is hard to tell.

Yep, at my school and all schools around my area if you get in a big fight, regardless of what happened, both people are suspended for 3 days. You could be just standing in the halls and someone thats pissed off at the world pick up something and proceed to beat the shit out of you for no reason and you would be suspended for 3 days. Or if people fuck with you, make fun of you, pick on you until finally you snap and beat the shit out of someone, your suspended for 3 days, even more if you end up screaming and cussing at em during it (happened many many times and they still do nothing). The kid was immediately suspended for 10 days and later expelled for the rest of the year by the school board...
A toy fucking gun... one he didn't even know was there. They expelled him under the "zero tolerance" weapons policy. Stupid asses
They later recanted and allowed him back in school when the finally removed their heads from their asses

Zero tolerance rules are in place for a reason. Mainly to to simplify the rules to avoid frivolous lawsuits by zealous parents. I don't particularly agree with them but without them pracitcally everyone grabs a lawyer and sues the school district every time the school administration tries to discipline their child. I recall reading an article about the birth of ZT policies in schools and the author citing examples of multiple urban high schools, some of them with a half dozen or more active lawsuits at any given time over disciplinary actions. Generally ZT policies are absolute and not very open to interpretation and therefore most lawyers consider them to be uncontestable. There have been some absurd cases like that grade schooler that got expelled for pointing a chicken finger at his teacher and saying "bang" and the teacher "felt threatened."
He could have easily avoided the situation by not giving her any prescription medication. Somehow I don't think we are getting the full story from the students/parents side. I'm not really the kind of person that is going to buy a story that she was so asthmatic that she was about to die right there on the spot if she didn't get a shot of her boyfriend's inhaler. I'm not an expert on asthma but I've never known an asmathic that bad, and generally inhalers just contain some type of steroid to facilitate breathing better. If the school nurse honestly thought she was in some kind of medical emergency she probably wouldn't have made a big deal of out if.
If they start making exceptions to zero tolerance policies then I honestly fail to see the point of them at all. You might as well drop them entirely and going back to trying to discipline kids with litigation attornies hanging over their heads.
It's pretty much the student's responsibility for being aware of the zero tolerance polcies and what offenses fall under them. If sharing prescription drugs and bringing toy weapons onto school property are governed by ZT policies (they are), then don't fucking do it. Just because you break a law by accident doesn't make you any less culpable.
Zero tolerance is the school's answer to the litigious society we live in. But if you can think of a better way to administrate discipline in a modern school system when the admin to staff ratio is shrinking almost as fast as the teacher to student ratio. There's more drugs in schools than there ever was, more crime, more weapons, more violence, and no money to combat it all effectively.
Also, you can be sued for administering first aid, even if you do it properly. There are multiple examples of successful lawsuits where the plaintiff was injured during CPR after drowning or a heart attack. Especially lifeguards get hit with this. It's not hard to crack or break a few ribs if you are administering CPR properly and they get sued for it all the time.
The US is in pretty bad need of torte reform.

That cracking rib example brought back memories. I used to be a lifeguard some 16 years ago and still remember how common an occurence cracked ribs can be while administering CPR. If you are licensed to perform CPR and do not, you can be sued as well.

Tort (no e, this isn't the Queen's Court, you hussy!) laws are indeed being reformed, although in most cases it is for the benefit of insurance companies, government and large corporations to limit the amount of liability they have.

Serving Size : 8
8 ounces chorizo sausage, casings removed
1 cup chopped onions
2 Clove Garlic,finely chopped
1 can (4 ounces) chopped green -- Chilis, drained
8 teaspoons Flour tortillas*
2 cups shredded Monterey Jack or a Mexican Blend
1 can (16 ounces) refried beans
1 jar (7 ounces) roasted red peppers, drained
Cook sausage, onions and garlic in 10-inch skillet over medium heat, stirring occasionally, until sausage is done; drain. Stir in green chilies; set aside. Heat oven to 400°. Grease pie plate, 10 X 1 1/2 inches.
Place 2 tortillas in pie plate. Spread half of the sausage mixture over tortillas. HOOKERWHORESLUT with half of the cheese. Place 2 tortillas on cheese.
Spread with beans. Place 2 tortillas on beans and place peppers on tortillas. Place 2 tortillas on peppers. Spread with remaining sausage mixture. HOOKERWHORESLUT with remaining cheese. Cover and bake 40 minutes. Uncover and bake 15 minutes or until cheese is melted and center is hot. Cool 10 minutes before cutting. Serve with salsa, sour cream or Guacamole if desired. Serves 8.

When I was younger some kids thought it would be funny to throw golf balls at my house. So I went inside and grabbed my pellet gun, pulled the blinds down on my window, sat there and waited for them to come back. Sure enough he comes back with his buddies to show them. He threw another one and I nailed him.. Little prick wasn't too happy but he had it coming to him.
