I found that funny, you think that was an actual notice or was that a little tongue-in-cheek? While I've heard of OSC, I've never really read him and I am not familiar with his sense of humor.
At any rate, it was a decent article. It was similar to the article that Drolgin posted in the Audiophilia forum, I hope there is an increasing trend of artists speaking out against the people that pay them. It could be the only way we see change.
I hadn't ever really thought about "upgrading", as Card put it. I had a shitload of VHS tapes that I ended up buying DVDs for, if I bought the license to view that work once, shouldn't I be able to own it in whatever format without buying another license for it?

I would say he certainly has better insight into copyright issues and more of a stake in protecting intellectual property than I do. He's certainly more qualified to speak on the issue than most of the clowns on this board that I read on a daily basis, and a better writer to boot!

I've read him. Sometimes he gets pretentious, but he's talented-- Enders Game is a pretty interesting book.

His take on copyright law (and the manipulation of it) is pretty accurate.
The replacement market is also valid. I never thought about it, but I had to buy quite a few CD's to replace the cassettes I'd bought and liked enough to want to hear in digital quality. However, I've replaced all the Beatles, Zepplin, B Boys, Metallica, ect. tapes I had and haven't bought a dupe in about 3 years.

Couple of salient points in his essay:
1) The "lost sales" figures are based on the same numbers that the games industry works on: Pirated Copies x Price Per Copy. Everyone in both industries knows this number is incredibly inflated, but it's the biggest number they can "reasonably" come up with to attempt to promote some outrage from the powers that be. They also don't take into account that people, myself amongst them, will go out and buy an original CD/game after being able to sample the full product, why else do they think there's such a large market for DVD's of movies you've already seen?
2) The music industry's sales have been boosted by MP3's in the same way that radio did. In fact, they know their sales are down because they keep pumping out mass produced filth and calling it art, but they need a scape goat and 12 year olds downloading nursery rhymes is *perfect*
Oh, and before you wankers start in, yes it's legally stealing, but I'm not depriving any starving artist of anything if I download something that I otherwise would never have bought.. and I can assure you, and the music industry, that no college kid is going to stop downloading 100 MP3's a month and start spending $200/month on CDs. Maybe $20, but they're probably already doing that now.
