Really the problem is not the searches in and of themselves, especially sinc the DOJ is only asking for the search text, not having it relate to the IP address of who did the searching. AOL, MSN, and Yahoo all rolled over and gave up the data, but in their defense, they are not that smart corporately and wityhout the IP info it is not a direct threat to privacy.
But I think Google is right in fighting it for four reasons
1. They realize that the IP address request is next, and they want to nip it in the bud.
2. Add in the fact that the data is to support a flawed law that was already struck down, and that it really has no relevance to correcting the problem (which is keeping kids from seeing porn online) which is really the parents fault they do, and hell, with no computers they will still find copies of playboy)
3. Google wants to be careful to maintain its position on the good side of the downside of the internet because they are thje only target bigger than MS for somone trying to be technologically destructive, i.e. Virii, Worms, trojans, DOS attacks etc.
4. Last but not least Google had a share price in the 440's and since they refused their share price has dropped 8% and is nearing something closer to reality as such.
But I think Google is right in fighting it for four reasons
