On paying for this retarded lawsuit. Do we really need to have age and sex discrimination cases when the job in question is a matter of public safety? When someone can't do the job as well as someone who is obviously younger and stronger, does it have to be pure discrimination? Now the taxpayers are paying for this dumbass. I hope her car gets keyed and tires slashed every fucking night.

MADEIRA - Part-time firefighter Barbara Barthel, 50, won her age and sex discrimination case last month against the Madeira-Indian Hill Fire District and its chief, Steve Ashbrock.

But she's still fighting for the job she wants.

Even though a jury awarded Barthel $63,000 in compensatory damages against the fire district and another $190,000 in punitive damages against Ashbrock, attorneys for both sides were in Hamilton County Common Pleas Court again on Monday.

Barthel's attorneys want Judge John O'Conner to order the district to give her the full-time firefighting job she didn't get in 2002. Or, they want the district to pay $475,305.12 - the money they say Barthel would have earned until retirement had she received the full-time position. They also want the district to pay $87,450.59 in attorney fees and court costs.

But Fanon Rucker, the fire district's lawyer, wants the jury's verdict thrown out, citing several legal technicalities. If the judge doesn't agree to that, he wants a new trial, or at least damages to be reduced or thrown out.

Rucker said the jury based its verdict on "emotions, passion and bias" instead of facts; that O'Connor gave incorrect instructions to the jury which prompted them to award "excessive" punitive damages against Ashbrock; and that the jury did not consider factors such as physical agility and written test scores for rejecting Barthel for the job.

One of two jobs went to a younger male who scored the second-lowest of 10 on the written exam, but second-best of nine on the agility test. The second position went to a younger male who ranked fifth in agility and fourth on the written exam. Barthel, who worked for the district since 1995, ranked sixth on the written exam and last on agility, according to court documents.

Stacy Hinners, one of three lawyers representing Barthel, reminded the judge that a part-time female firefighter testified in trial that Ashbrock said, "I'm never going to hire a woman full-time."

When Barthel asked Ashbrock what she needed to do to get promoted, Hinners said Ashbrock told her: "Don't you get it? You're too old and you're a woman. Give it up."

O'Connor said he will issue a decision on the motions in a week, but instructed attorneys to work at a settlement in the meantime. Rucker wants terms of any settlement sealed and also asked O'Connor to consider placing a gag order on those involved in the case.

Barthel sued in 2003 after being passed over for promotions to full-time in 2000 and 2002, and for a captain's position in 2001.

After a five-day trial last month, a jury ruled in the district's favor for the alleged incidents in 2000 and 2001, but decided that the fire district and Ashbrock had discriminated against Barthel in failing to hire her full-time in 2002.

Thats what fucked up the whole case for the guy. If he would have just left gender out of this, he could have easily won saying she doesnt meet the physical requierments for the job.

Most if not all fire departments have lowered the physical agility testing standards to make it less "age and sex discriminating." This is scary to me as a firefighter. 90% of victims that firefighters drag out of a burning building will be another firefighter.

My thoughts exactly. There are times when it's best to just STFU.

I use to work for this small ISP where one owner came from Lockheed and the other was a small business owner and redneck from Arkansas. It was quite an interesting mix but in general things went well. We just kept the redneck owner from going to meetings with very large customers.

When I left they were in the middle of selling the company to some swindlers, which is why I was leaving. Right after they did they purchased it back but not before this new owner made them fire the 5 highest paid employees. Good thing for me beacuse I was able to hire 3 of them at the company I went too. However it left them w/o any real network and server support.

So they started interviewing people, one guy, who was pretty good, but not really the caliber they needed seemed good enough that they might give him a shot but they still needed to discuss. Towards the end of the lunch interview the redneck owner said (and I'm not kidding either) "Well you seem pretty good, we just might hire you if you are gay or something." At which point the other owner tried to crawl under the table... the applicants response was "Well I am gay, is that a problem?"

Needless to say they did hire this person for WAY more than he was worth. Once he got on board and the story got out a secretary they had, whom I thought everyone knew was gay anyway, went and ask/complained that she wasn't being moved up because they were prejeduce... so she got a big raise and was moved into a mgt postion. These 2 things eventually killed the company's growth so they sold it to most of their resellers.

So what we have is 2 people who got more money and more power than they could handle OR diserve because some idiot couldn't STFU. Yea he was a little homophopic but not really, especially not for Arkansas. He really didn't care if they were gay or not but thought the joke would be funny and look would it cost him. I'm not sure it's right that they got those positions they didn't diserve just because they were gay but hey, someone throws it out there, it's out there. Better just to keep your mouth shut. It dosen't matter if someone is red, green, blue, gay, straight etc... all he relaly needed to know was "can you route? and "do you know IOS and Linux?"

yeah, the guy who created this lawsuit essentially has no professional skills of his own, and also is not qualified to do his job since it requires basic business skills like managing personnel.
