Another "OMG they're monitoring the internets!" outcry, ironically brought on my the provider itself. From reading it they're just looking at IP headers which is a far cry from decoding all the packet streams and parsing the contents.

Even in the EU that's not an illegal wiretap.
...it has now been revealed that they have apparently employed deep packet inspection (DPI) to monitor customers' use of WhatsApp (and also VoIP services) — which happens to be illegal in the Netherlands.

I suppose it's possible but having worked around\on this sort of thing for a while actually doing it at that level is... hard. And expensive, and obvious.

Isn't packet header inspection necessary for QoS?

The OP isn't sure. They start off talking about DPI then say it might only be headers, and nowhere is looking at headers people send to you illegal; it's not just necessary for QoS, it's necessary for routing or doing anything else with the packet other than ignoring it.
